Terms & Waiver

BUYING CLASS CREDITS AND CREDIT CARD INFORMATION

When you buy class credits or packages from Grind House Cycle, you agree to our terms and conditions in full. Riders may elect to keep a credit card on file using their Grind House Cycle account. By placing a card on file, the cardholder and account holder permits Grind House Cycle staff to charge the card for any in-studio purchases made by the client unless the client provides an alternate form of payment.

SIGN-UP FOR A CLASS

To book a class at Grind House Cycle you must create an account and purchase a credit for a single class, a class package, or a monthly membership. All classes can be booked online, in studio, or by giving us a call. Registration of minors (ages 12-17) must be completed in person at our studio with the involvement of a parent or legal guardian who will sign the waiver.

MONTHLY MEMBERSHIP

When you purchase a monthly membership from Grind House Cycle, you agree to our terms and conditions in full. Monthly pass riders are required to keep a valid credit card on file. By purchasing a monthly membership, the cardholder and account holder permits the Grind House Cycle staff to charge the card every 30-days for their membership fee and also for any in-studio purchases made by the client unless the client provides an alternate form of payment.

Monthly membership is available with auto-renewal only. Monthly members are required to keep a valid credit card on file. If your credit card is declined you have a 3 day grace period to make a payment before we freeze your pass. Monthly memberships are nontransferable. Monthly members must cancel at least 12 hours in advance of the class to avoid penalty. 

Monthly memberships require a three-month commitment before cancellation eligibility.

You may freeze your membership once a year for 30 days, freezes are not prorated and they must coincide with billing periods. Freezing your membership during the first 3 months of your contract will automatically extend your commitment.

You may cancel this Membership Agreement at any time, after the 3-month period. If you choose to cancel before the 3-month commitment, a cancellation fee of $200.00 will be charged to your card on file.

You may cancel a membership within 30-day notice of the renewal by submitting a written cancellation request via email to contact@grindhousecycle.com or by calling Grind House Cycle at (760) 309-9474.

Note that if you have a scheduled payment within this 30-day period, the payment will be processed as scheduled. All payments are non-refundable.

For example, if you submit your request on the 15th of the month and your next billing date is on the 1st of the following month, you will be responsible for that next payment and will have access to the studio until the end of that billing cycle.

If at the time of receipt of your cancellation notice, you have outstanding payments owed to Grind House Cycle, these payments must be made in full in order for the Membership Agreement to be considered canceled. In the event that you fail to pay outstanding amounts owed, your membership will be considered suspended, the Membership Agreement will not be canceled, and Grind House Cycle reserves the right to pursue additional avenues or means to receive monies owed.

CANCELLATIONS

We understand when things come up, cancellations happen. If you need to cancel your booking, please do so 12 hours before your scheduled class by going online, speaking to our team at the studio or giving us a call at (760) 309-9474. If you cancel after the allotted time or are a no-show, you will forfeit the class and be charged a penalty fee to the card on file.  

No show cancellation fee: $20. Late cancellation penalty fee: $15.

ARRIVE EARLY

We recommend that you arrive at least 15 minutes before class starts to let our team know you are a new rider. We will greet you and get you set up on your bike and essentials.

SIGN-IN 

Please check-in with our team at the front desk upon entering the studio. If you have any questions about your reservation, they will be able to assist you.

LATE ARRIVALS

If you are not signed in by 5 minutes before the scheduled class time, bikes will be released to riders on the waitlist. 

If you are running late, please call the studio and let us know you are on the way. Our front desk team will hold your bike for up to 5 minutes after class begins. although we cannot guarantee it will be the same bike you signed up for. As a courtesy to your instructor and your fellow riders, if you arrive more than 5 minutes after class begins, you will not be allowed in class.


FOR RIDERS LEAVING EARLY

If you are planning on leaving early, please let your instructor know before class starts.

WAITLISTING

You can add your name to our waitlist for any class that is fully booked. Once you get a spot, you will receive confirmation via email and if the spot is confirmed within 12 hours of the scheduled class, a team member will call you to confirm.

RETURN AND EXCHANGE POLICY

Classes, class packages, merchandise, and event tickets are non-refundable and non-transferable. Retail items returned within 7 days of purchase, tags attached, can be exchanged. All sales are final sale.

CREDIT EXPIRATIONS

All of Grind House Cycle’s class credits have a limited usage window. First time rider (two for one promotion) expires 14 days from date of purchase. Single class credit expires 30 days from date of purchase. 5 class pack credits expire 60 days from date of purchase. 10 class pack credits expire 90 days from date of purchase. 4 classes and 8 classes monthly memberships do not roll over. All memberships and package credits are non-transferable. If you cancel your class within the cancellation window the credit expiration date does not change. Credit expiration dates expire from date of purchase. If credits expire without use you must purchase new credits. We will not provide credit extensions for expired credits.

RELEASE AND INDEMNITY AGREEMENT

This RELEASE AND INDEMNITY AGREEMENT (“Release”) is made to release and indemnify Grind House Cycle LLC, a California State limited liability company, and all of its respective members, employees, heirs, successors, agents, contractors and assigns (collectively the “Released Parties”).

The undersigned, on his/her own behalf or, if applicable, as the parent or guardian of a minor (the person engaged in the activities with Grind House Cycle shall be referred to hereafter as the “Participant”), and on behalf of the undersigned’s heirs, successors, representatives and assigns (singularly and collectively the “Releasing Parties”), hereby grants the Released parties this full release and indemnification as consideration in exchange for permitting Participant to participate in this exercise program or any other activity associated with or through the Released Parties.

Participant is entering into this Release after having viewed or having the opportunity to view the studio and instructors’ qualifications and having had the opportunity to ask questions regarding the services and risks associated with this exercise program. Participant further acknowledges that his/her participation in the activity is voluntary with full knowledge, understanding and appreciation of the risk inherent in any physical exercise and expressly assumes all risk of injury and even death, which could occur by reason of Participant’s participation.

Despite all known and unknown risks, including but not limited to bodily injury (including death) and property loss or damage, the undersigned, on behalf of the Releasing Parties, hereby releases, waives, acquits and forever discharges any and all known or unknown claims, demands, causes of action, damages, losses, and expenses that the Releasing Parties may ever have or have had against the Released Parties arising out of Participant’s participation in any activity or exercise program offered by the Released Parties, including, but not limited to, any and all claims which alleged negligent acts and/or omissions committed by Released Parties or any third party.

By signing, I acknowledge and agree that I should consult any medical practitioner prior to participating in any actives with Grind House Cycle or using its facilities, especially if I had, have, or develop a serious health condition, including but not limited to stroke, lupus, hernia, numbness in the extremities, orthopedic condition, heart condition, asthma, breathing problems, faintness, dizziness, loss of balance, recent injury/surgery/ concussion, or current pregnancy.

The Releasing Parties further agree to indemnify, defend and hold harmless, the Released Parties from any and all claims arising out of the Participant’s participation in any activity or exercise program offered by the Released Parties or in the use of any equipment at the Grind House Cycle studio or any other premises owned, leased or used by the Released Parties, without limitation, attorneys’ fees and expenses incurred by the Released Parties.

All personal property brought to the studio or any other location where the Participant is participating in any activity or exercise program offered by the Released Parties, is brought at the sole risk of the Participant as to its theft, damage, or loss.

The Released Parties are not responsible for any items left at the Grind House Cycle studio or any other premises owned, leased, or used by the Released Parties.

Participant hereby permits the Released Parties to use, without compensation or royalties, images or video of Participant as a program participant, including but not limited to its social media or web-based materials, broadcast and print advertising, and websites produced and published by the Released Parties. All such materials are deemed property of the Released Parties.

Participant expressly agrees that the terms of the release and indemnity contained herein are intended to be as broad and inclusive as is permitted by the laws of California. Any provision of this Release found to be invalid by the courts having jurisdiction shall be invalid only with respect to such provision or portion and the remainder shall be enforced to the greatest extent possible. Furthermore, any dispute arising out of this agreement shall be subject to binding arbitration.

Participant agrees to maintain current credit card information on file and authorizes Grind House Cycle to charge the credit card on file for the payment of services and fees. This credit card is kept on file and will remain in effect until the expiration of the credit card account.

We will not seek, use, or disseminate any information from unauthorized access, use, modification, or disclosure. These files are confidential and will only be used by the studio to better support your needs.

PARTICIPANT ACKNOWLEDGES THAT HE/SHE HAS READ, UNDERSTANDS AND VOLUNTARILY AGREES TO THE TERMS SET FORTH IN THIS RELEASE AND INDEMNITY AGREEMENT

COVID-19 ACKNOWLEDGMENT

In addition, the undersigned acknowledges that novel coronavirus (“COVID-19”) infections have been confirmed throughout the United States, including several cases in the state of California. In accordance with the most recent guidance and protocols issued by the World Health Organization (WHO), the Centers for Disease Control and Prevention (CDC), the California Department of Public Health (CDPH), for slowing the transmission of COVID-19, the undersigned hereby agrees, represents, and warrants that neither the undersigned nor such participating guests and children, shall visit or utilize the facilities, services, and programs of Grind House Cycle within 14 days after (i) returning from highly impacted areas subject to CDC Level 3 Travel Health Notice, (ii) exposure to any person returning from areas subject to a CDC Level 3 Travel Health Notice, or (iii) exposure to any person who has a suspected or confirmed case of COVID-19.

THE UNDERSIGNED, ON HIS OR HER BEHALF AND ON BEHALF OF SUCH PARTICIPATING CHILDREN, HEREBY RELEASES, WAIVES, DISCHARGES AND COVENANTS NOT TO SUE, Grind House Cycle, its directors, officers, employees, volunteers and agents from all liability to the undersigned or such participating children and all personal representatives, assigns, heirs, and next of kin of the undersigned or such participating children for any loss or damage, and any claim or demands on account of any property damage or any injury to, or an illness or the death of, the undersigned or such participating children (or any person who may contract COVID-19, directly or indirectly, from the undersigned or such participating children) whether caused by negligence, active or passive, of Grind House Cycle, or otherwise while the undersigned or such participating children are in, upon, or about the premises or any facilities or equipment therein or participating in any program affiliated with Grind House Cycle.

The undersigned expressly and knowingly waives all rights under the laws of the State of California.
